CORRUPT COUNTY PROSECUTOR DINO HOLMAN, LIKE LAPDOG COLLIER, IS SHOWING HIS DESPERATION!

Like corrupt Medina County Judge LAPDOG COLLIER, CORRUPT MEDINA COUNTY PROSECUTOR DINO HOLMAN is getting desperate, and he's beginning to show it!


HOLMAN, like all other corrupt politicians, doesn't like being held accountable for his corrupt conduct.  In fact, until the present day, no one has ever challenged him.

In the case being profiled at this blog, the Defendant's Trial Counsel has been holding HOLMAN's feet to the fire and he does not like it one little bit.

How dare an attorney, outside of the local old boy network of attorneys, dare to question his lack of integrity, or his usual and customary unethical and unlawful practices?

So, HOLMAN, in his usual and customary fashion, violates once again the Sixth Amendment by moving to deprive this Defendant of competent legal representation.  After all, why should this defendant have any legal representation at all?  After all, the Defendant, a factually innocent person was railroaded into prison by HOLMAN, SALISBURY, AND LAPDOG JUDGE COLLIER.  This, of course, is wishful thinking by HOLMAN, who deserves nothing less than his own trial in U.S. District Court for his role in denying the citizens of Medina County, as well as this Defendant, their rights  and protections accorded them by the United States Constitution.


THE CONSTITUTION OF THE UNITED STATES, AS HOLMAN SEES IT, IS NOTHING MORE THAN A "SCRAP OF PAPER!"

Now, in yet another abomination, HOLMAN has filed a brief, no doubt objecting to a correction of the trial record which has been tampered with, altered, and changed to the intended benefit of his office and the intended benefit of his LAPDOG, MEDINA JUDGE CHRISTOPHER COLLIER.


As the reader can tell from the entry below, taken directly from the website of the Medina County Clerk of Court, HOLMAN does not want the public to see that objection, since the brief cannot be viewed by the general public.


SO, HOLMAN IS NOW MOST CERTAINLY OBJECTING TO ANY CORRECTION TO THE TAMPERED TRIAL TRANSCRIPT, AND WANTS TO DEPRIVE THIS DEFENDANT OF HIS COMPETENT AND AGGRESSIVE DEFENSE COUNSEL, ALL IN HIS OWN SELF-INTEREST.


It must be said the HOLMAN actually believed that no one would catch the fact that the trial record had been tampered with, primarily because no has ever detected the tampering before.

9th DISTRICT COURT OF APPEALS: "(COLLIER) SHOULD NOT HAVE LET (SALISBURY) GET AWAY WITH IT!"

The precise words of the 9th District Court of Appeals, chastising LAPDOG MEDINA JUDGE CHRISTOPHER COLLIER, THE VILLAGE IDIOT AND TOWN WHORE, are found in a recently decided appellate decision in the case of State v. Precisely, the 9th District Court of Appeal, in a decision issued on July 25, 2011, held:

The prosecutor’s “cross-examination” of these women was improper, and the trial court should not have allowed him to get away with it.

 The Court of Appeals was commenting on the conduct of both LAPDOG JUDGE COLLIER and Medina County Ass. prosecutor SCOTT SALISBURY, THE PATHOLOGICAL LIAR!


What the Court of Appeals has not recognized is that COLLIER, A LAPDOG OF MEDINA COUNTY PROSECUTOR DEAN HOLMAN,  has been letting SALISBURY, THE PATHOLOGICAL LIAR, "get away with it" for years!


Simply put, letting SALISBURY, THE PATHOLOGICAL LIAR "get away with it" is the only way that LAPDOG COLLIER, a Republican, can retain his uncontested lifetime appointment to the Medina County bench, compliments of CORRUPT MEDINA COUNTY PROSECUTOR DINO HOLMAN and the Medina County Democrat Party.


The blogger has taken the time to read prior decisions of the 9th District Court of Appeals, found at http://www.ninth.courts.state.oh.us/.  Armed with the knowledge of the corrupt practices of LAPDOG COLLIER and the criminal assistants of CORRUPT MEDINA COUNTY PROSECUTOR DINO HOLMAN, those opinions have quite a tale to tell!


The substance of some of those prior appellate decisions, when placed in the context of the finding of the 9th District Court of Appeals in the recent Johnson Opinion, cited above, reveals a longstanding history of misconduct by LAPDOG COLLIER and SALISBURY, THE PATHOLOGICAL LIAR.


Certain of those prior decisions of the 9th District Court of Appeals will be profiled in future segments of this blog, and compared with the Johnson Opinion, and the unethical and unlawful conduct of LAPDOG COLLIER and SALISBURY, THE PATHOLOGICAL LIAR in the case being profiled at this blog.

SALISBURY, THE PATHOLOGICAL LIAR claims that a Corrupt Federal Judge will perpetuate the CORRUPTION IN THE MEDINA COUNTY COURTS!

In a rather interesting turn of events, Medina Ass. prosecutor SCOTT SALISBURY, THE PATHOLOGICAL LIAR, relies upon the presumption that the corruption that pervades the Medina County Courts reaches well into the Federal Judiciary!


On Saturday, August 20, 2011, SALISBURY, THE PATHOLOGICAL LIAR, sent the following email message to this blog:

What you fail to understand is, that the FBI does not care. You see, the Chief Judge of the United States District Court for Northern District of Ohio is none other than the wife of current Ohio Representative for the 69th District, Bill Batchelder. Who preceded Collier as judge, who you regard as corrupt. And given how corruption works, does it not seem like Collier was not the first, considering how Holman, who you regard as corrupt has been in office since 1988. The fact is that she will throw out any case, if what you claim about corruption is true.

THIS SEEMS TO BE NOTHING MORE THAN WISHFUL THINKING ON THE PART OF SALISBURY, THE PATHOLOGICAL LIAR.

SALISBURY, THE PATHOLOGICAL LIAR, imputes to Federal Judge Alice Batchelder and the Federal Judiciary the same level of corruption that pervades the Medina County Courts.  Contrary to his claims, SALISBURY has not, and cannot, produce any compelling evidence that Judge Batchelder is corrupt, as he alleges.

Further, since SALISBURY, THE PATHOLOGICAL LIAR, has been so busy conspiring with LAPDOG JUDGE COLLIER to deprive innocent citizens of their constitutional protections in order to railroad the innocent to prison, he has failed to keep up with current events.

Contrary to SALISBURY'S assertion, Judge Alice Batchelder sits on the 6th Circuit in the U.S. Court of Appeals in Cincinnati, Ohio, and is not the Chief Judge for the Northern District of Ohio.

Once again, the SALISBURY'S hopes and wishful thinking that an allegedly corrupt Federal Judge Alice Batchelder will throw out any Federal indictment levied against him, LAPDOG JUDGE COLLIER, and CORRUPT MEDINA COUNTY PROSECUTOR DINO HOLMAN, have been dashed by the FACTS.


One would have to believe that Rep. William Batchelder and the Honorable Federal Judge Alice Batcheldeer will be none too pleased when they learn that SALISBURY, THE PATHOLOGICAL LIAR, acting in concert with LAPDOG MEDINA JUDGE COLLIER and CORRUPT MEDINA COUNTY PROSECUTOR DINO HOLMAN, has alleged that FEDERAL JUDGE BATCHELDER IS AS CORRUPT AS THEY ARE.

LAPDOG COLLIER HEARS FOOTSTEPS, SEEKS LEGAL ADVICE !

It would seem that LAPDOG JUDGE COLLIER, THE VILLAGE IDIOT AND TOWN WHORE, is beginning to come to the realization that he will soon be facing more than defendants from his perch on the Medina County Bench.

In a prior segment of this blog, readers were treated to an exchange between LAPDOG COLLIER and SCOTT SALISBURY, THE PATHOLOGICAL LIAR taken from a part of the trial record that the criminals at the Medina County Courthouse/Mosque & Railroad Station had not changed, all to their intended benefit.


The exchange concerned whether or not a defendant charged with the burglary of an occupied dwelling would be entitled to a jury instruction on the lesser-included offense of Criminal Trespass, a misdemeanor offense.


LAPDOG COLLIER endorsed the unlawful position of SALISBURY, THE PATHOLOGICAL LIAR, and refused to give the instruction to the jury on the lesser-included misdemeanor offense because, AS THEY BOTH AGREED ON THE RECORD, the burglary of an inhabited dwelling bars the trial judge from giving the lesser-included misdemeanor instruction, thus foreclosing the jury from finding the Defendant guilty of a misdemeanor.


ONE PROBLEM, HOWEVER.  LAPDOG COLLIER APPARENTLY FORGOT THAT THE 9TH DISTRICT COURT OF APPEALS OVERTURNED A CONVICTION IN ONE OF HIS TRIALS A YEAR PRIOR FOR FAILING TO GIVE THE LESSER-INCLUDED OFFENSE INSTRUCTION TO THE JURY.


IN OTHER WORDS, LAPDOG COLLIER AND SALISBURY, THE PATHOLOGICAL LIAR, DELIBERATELY VIOLATED THE HOLDING OF THE 9TH DISTRICT COURT OF APPEALS THAT THE MISDEMEANOR OFFENSE OF AGGRAVATED BURGLARY IS A LESSER-INCLUDED OFFENSE AND THAT THE LESSER-INCLUDED INSTRUCTION MUST BE GIVEN, CONSIDERING THE EVIDENCE IN A LIGHT MOST FAVORABLE TO THE DEFENDANT.


A PERFECT EXAMPLE OF JUDICIAL AND PROSECUTORIAL MISCONDUCT AND CORRUPTION IN THE COURTS OF MEDINA COUNTY.

Turning now to another aggravated burglary case presently filed in the Kangaroo Courts of Medina County, on June 16, 2011, the Office of CORRUPT MEDINA COUNTY PROSECUTOR filed a motion to transfer an aggravated burglary case away from Judge Kimbler to the courtroom of LAPDOG COLLIER, with the obvious knowledge that LAPDOG COLLIER would deprive this defendant of his rights, as he's done to so many other defendants, and railroad that defendant, again as LAPDOG COLLIER has done so many times in the past.

The Medina Water Department, ever eager to please "public officials," has just installed a NEW, PERSONAL FIRE HYDRANT IN THE CHAMBERS OF LAPDOG MEDINA JUDGE CHRISTOPHER COLLIER, following a number of citizen complaints. It seems when there are no INNOCENT CITIZENS FOR LAPDOG COLLIER TO PISS ON, HE HAS HAD TO "RELIEVE" HIMSLF AT A NUMBER OF FIRE HYDRANTS ON MEDINA'S PUBLIC SQUARE. A number of female dog walkers have complained that LAPDOG COLLIER has been elbowing them out of the way to get to his favorite "watering holes." One irate citizen complained, "I'M TIRED OF LAPDOG COLLIER PISSING ON MY BOOTS." Seems like rank hath its privileges.

Security personnel at the Cleveland IX Center refused entry to Medina LAPDOG JUDGE CHRISTOPHER COLLIER, who attempted to attend a recent national dog show held there. Citing a longstanding regulation that all non-competitor dogs, and especially lapdogs, must be on leash, security officers observed that COLLIER was unattended by any member of the Medina County Prosecutor's Office and was thusly determined to be off leash. TAMPERING WITH THE TRIAL RECORD !!!

The blogger has recently discovered an astonishing new wrinkle in the corruption at the Medina County Courthouse/Mosque & Railroad Station.

IT SEEMS AS THOUGH SOMEONE OR SOMEONES OVER AT THE MEDINA COUNTY COURTHOUSE/MOSQUE & RAILROAD STATION HAS/HAVE TAMPERED WITH THE TRIAL RECORD IN THE MATTER OF THE CASE BEING PROFILED HERE AT THE BLOG.


THIS IS CERTAINLY AN INTERESTING DEVELOPMENT AND INDICATIVE OF THE LEVEL OF COMPLETE CORRUPTION TO BE FOUND IN THE MEDINA COUNTY COURT SYSTEM.


Firstly, it is significant to take note of the fact that LAPDOG COLLIER appointed an attorney, different from the Defendant's trial attorney, to represent the Defendant in his Direct Appeal.


Logically, as LAPDOG COLLIER'S thought process went, the trial transcript would not likely be reviewed by the Defendant's trial counsel.  LAPDOG COLLIER was completely incorrect in that assessment.

Secondly, it took the court reporter 13 months following the conclusion of Defendant's trial to file the trial transcripts with the Court of Appeals, having requested and been granted no fewer that 8 extensions of time to complete and file the trial transcript.  However, the court reporter managed to file no fewer than 7 transcripts of hearings and full trials with the Court of Appeals, all heard after the conclusion of the Defendant's trial!


LAPDOG COLLIER, SALISBURY, THE PATHOLOGICAL LIAR, and CORRUPT MEDINA COUNTY PROSECUTOR DINO HOLMAN MUST BE SLOW READERS!


IS IT POSSIBLE THAT THE DELAY IN FILING THE TRIAL TRANSCRIPTS WAS DUE TO THE TIME NEEDED BY LAPDOG COLLIER, HOLMAN, AND SALISBURY, THE PATHOLOGICAL LIAR, TO PROOF-READ, EDIT, AND DOCTOR THE TRANSCRIPTS?


MAYBE SO !


What LAPDOG COLLIER, SALISBURY, THE PATHOLOGICAL LIAR, AND CORRUPT COUNTY PROSECUTOR DINO HOLMAN did not accurately predict was that the Defendant's trial counsel and her investigator would READ the trial transcripts.


As it turns out, there are some glaring omissions in the trial record.  Inappropriate comments made by LAPDOG COLLIER during the proceedings, but well remembered by witnesses, are not to be found in the transcript.  Also, challenges made by witnesses to SALISBURY'S honesty and integrity, or more appropriately the lack thereof, offered in trial testimony are mysteriously missing from the record.

The blogger fully understands how a court reporter may miss some of the commentary during heated exchanges in court.

Yet, what is particularly puzzling is that there are gaps in witness testimony that go directly to issues raised by the Defendant on appeal, witness testimony and comments from LAPDOG COLLIER which prove unequivocally that LAPDOG COLLIER DEPRIVED THIS DEFENDANT OF A FAIR TRIAL. 


Who could possibly benefit from these omissions from the trial transcripts?  Certainly not the Defendant!


It is rather curious that the gaps in the trial transcripts seem to align with issues of improprieties submitted to LAPDOG COLLIER in a defense brief filed in it's Motion for a New Trial, found at http://www.co.medina.oh.us/medct_epublicnodr/pages/viewdoc.aspx?case=09CR0229&p=1&a=77


Given the fact that the trial transcript is clearly neither accurate nor complete, Defendant's trial counsel filed a Motion to Correct Transcripts, setting out in detail deficiencies in the transcript that are currently known.  The Motion to Correct Transcripts can be found at http://www.co.medina.oh.us/medct_epublicnodr/pages/viewdoc.aspx?case=09CR0229&p=1&a=122

Further, tampering with and altering the trial record is just one more felony offense, TAMPERING WITH RECORDS, in violation of Section 2913.42(A) of the Ohio Revised Code, a FELONY OF THE THIRD DEGREE.


Section 2913.42, Tampering With Records, provides:

(A) No person, knowing the person has no privilege to do so, and with purpose to defraud or knowing that the person is facilitating a fraud, shall do any of the following:

(1) Falsify, destroy, remove, conceal, alter, deface, or mutilate any writing, computer software, data, or record;

(2) Utter any writing or record, knowing it to have been tampered with as provided in division (A)(1) of this section.

(B)(1) Whoever violates this section is guilty of tampering with records.

(2) Except as provided in division (B)(4) of this section, if the offense does not involve data or computer software, tampering with records is whichever of the following is applicable:

(4) If the writing, data, computer software, or record is kept by or belongs to a local, state, or federal governmental entity, a felony of the third degree.


IT MAY REQUIRE INQUIRY BY THE FEDERAL GRAND JURY, BUT THIS "MYSTERY" WILL BE SOLVED, IN THE INTERESTS OF JUSTICE.


The criminals, and stupid criminals at that, over at the Medina County Courthouse/Mosque & Railroad Station, the "guardians" of the public safety, seem to racking up quite a collection of felony offenses themselves, although as yet unindicted.


THERE IS ABSOLUTELY NO DOUBT THAT THE CORRUPTION IN THE MEDINA COUNTY COURTS MUST BE ADDRESSED BY THE CRIMINAL DIVISION OF THE UNITED STATES DEPARTMENT OF JUSTICE !
